Boundless Vision Ltd terms of trade. If you are considering or are already working with us, please read through the following so you are aware of the conditions of services delivered.
1. Definitions
1.1 We: Includes Boundless and all of our staff
1.2 Our: Includes Boundless and all of our staff
1.3 You: The client
1.4 Raw footage: The video & photos that come straight out of camera are not provided.
1.5 Shoot or Production day: The day we create the video or photos
1.6 Post production: The process of editing video and photos
2. What You Own
2.1 You receive a licence to use the final edited videos and photos for use as you require in their final edit format as we delivered.
2.2 You are responsible to keep these safe either online or on hardware.
2.3 You do not own the right to distribute the media to third parties for their advertising needs. Eg. If we have taken a photo of a home you are selling, you cannot give the photo to the home builders to use in their advertising without purchasing licensing rights. See below for licensing fees.
2.4 While you own the final edited video, this does not include the right to create new content from our video. If you intend to use footage from a Boundless Vision video in other projects edited by another party (other than Boundless Vision – e.g. editing them into a new video) you need to notify us of this intent and ask if there is a licensing fee needed to use our footage in this manner. These requests will be analysed and handled on a case-by-case basis.
3. What We Own
Real estate: We (Boundless Vision) retain copyright ownership of all media created.
We grant a non-transferable, non-exclusive licence to the agent or agency to use the media only for the duration of their listing agreement.
This licence does not transfer if the listing changes hands.
3.1 We own all the raw footage and the edited final footage.
3.2 We obtain the right to use the final material for projects and marketing on Boundless Vision media platforms.
3.3 We own the right to distribute, eg. we can provide the above mentioned building company with a license to use the photography if we so choose.
3.5 We can relicense the imagery form a photoshoot when applicable. Media relicensing to a third party (e.g. another agent or agency) requires written consent from the original licensee. In the absence of consent, relicensing will not be permitted.
4. Storage
4.1 We store footage for 3 – 6 months after delivery of the final project.
4.2 Sometimes accidents happen, we cannot be held responsible for the loss of footage, or if it has been deleted without us being notified to hold on to it by you. 4.3 We hold the right to charge a fee for storage should you request that we keep footage for longer than 6 months.
5. Cancellations and Postponements
Shoot or Production day cancellations and postponements for Real Estate
5.1 We understand that in our business the weather plays a huge part in delivering the absolute best imagery of a property or project and we will not penalise you for weather not playing its part. Therefore we do not charge postponement fees for shoots rescheduled due to weather or Covid related illnesses that make the property or its habitants or agents unable to provide access to the property.
5.2 All other postponements and cancellations will be treated as below at our discretion:
a. 1 x Free reschedule up to 48 hours from the shoot date
c. Rescheduling within 36 hours from shoot: $200
d. Cancelation fee within 36 hours: $200
e. On the day cancelation: 50% of shoot fee
Shoot or Production day cancellations and postponements for Corporate & Commercial
5.3 This type of work takes a large time commitment from us and when we commit to exciting and big projects, it requires us to block our schedule out which means we are unavailable for our regular weekly clients for the period of the production.
a. Non-weather related cancellation before 7 days of production: We charge for all the work that was done to date and any costs acquired, e.g. scriptwriting, accommodation bookings and all pre production work completed.
b. Within 7 days: We charge for all the work completed as well as 50% of the on the day production costs should a project be cancelled within 7 days prior to production.
c. We charge the full production charge if cancelled within 48 hours.
Non-weather related rescheduling within 48 hours: $500
Non-weather related rescheduling on the day: 50% of the production day cost.
6. Hours/Days of Operation
6.1 We ordinarily provide media services Monday to Friday, 9am to 5pm.
6.2 We do offer services outside these hours including sunrise, sunset and twilight shoots. Information regarding these can be found on our booking form or by enquiring. 6.3 We may also provide services on weekend days by application only and may or may not be able to provide such services depending on the availability of our production team.
6.4 Rates for weekend work can incur a 25% surcharge, this will be communicated upon booking.
7. Cleaning & Decluttering (for real estate, architectural shoots etc.)
7.1 Should we arrive to complete media services at a property and find furniture, fixtures or decorations not in the appropriate position or state we hold the right to charge for the time taken to make the set media ready.
a. The fee for this is $150 and will be invoiced without prior notice given should this service be required in order for media to be completed on shoot day.
7.2 A media team’s job is to capture what is there. We therefore cannot be held response for the state in which a property or film set is presented.
7.3 Although we go out of our way to declutter while we shoot, should we feel that a property is not on proper hygiene levels, we hold the right not to touch the surfaces of that home.
7.4 It is the responsibility of the client to ensure a property is properly prepared and ready to be shot upon our arrival.
7.5 Please do not arrange for a property to be decluttered during our shoot as this effects the shooters ability to do their job. Please have the property decluttered before we arrive.
7.6 For the safety of tenants and their belongings, we do not declutter rental properties to the same standards we do owner occupied properties.
7.7 We do not wash dishes, vacuum, clean floors, make beds or perform any activity that is considered cleaning rather than decluttering. Should this be needed our cleaning fee will be charged.
8. Quotations
8.1 Quotations are priced on a job by job basis, specific to the type of work to be carried out, equipment required, time and experience. One round of customer changes and or revisions is included in each quotation unless otherwise specified on quote.
Requests for additional changes after one round will incur a fee to be quoted and agreed upon.
8.2 If the customer requires significant changes then Boundless Vision shall be entitled to charge additional Agree Fee based in further quotes.
8.3 Quotations can change at any time by the discretion of Boundless Vision.
9. Customer Responsibilities
9.1 The customer is required to obtain all necessary permissions and authorities in respect to the use of any materials, venues, locations or people used in the customers video or photo’s.
9.2 The customer indemnifies and holds Boundless Vision harmless from any claims or legal actions related to the content of the customers videos.
9.3 Boundless Vision reserve the right to discretion on when and where videos and images will be taken during the course of the event but will make every effort to comply with the customers requirements.
10. Legal Costs
10.1 The customer will be held liable for any legal charges or fees incurred to Boundless Vision in the recovery of unpaid invoices on an indemnity basis.
11. Right of Termination or Refusal
11.1 Boundless Vision media reserve the right to refuse or terminate the provision of services if:
a. Any persons employed by Boundless Vision or contracted is placed in a position where there is an actual or apparent risk to them or any equipment or people may be harmed or damaged.
11.2 if Boundless Vision refuse or terminate the provision of services due to Clause 14.1 then the deposit paid by the customer is non-refundable.
11.3 Should any of the circumstances outline in clause 14.1 occur, Boundless Vision reserve the right
to seek compensation from the customer for any damages or losses suffered as a result.
12.Equipment Failure or Illness of Boundless Vision Employees and Contractors
12.1 Whilst Boundless Vision will take all reasonable care and preparation to ensure photography, videography and editing proceeds as provisioned, we will not be liable for any compensation except for return of any deposit paid to Boundless Vision in the instance that an equipment failure occurs of any equipment required to complete the services by which we have been engaged; or any illness of the operators employed or engaged by Boundless Vision or because of any unforeseen event which results in our inability to complete the services required.
13. Permissions & Venue Location Fees
13.1 Boundless Vision is not responsible for any consent or permissions or to pay any fees required to film at a particular location, venue or event whether private or public. The responsibility falls solely on the client to ensure the above is carried out prior to date of filming.
14.On-Set Safety
14.1 As a responsible employer, we hold the safety of our employees as most important. We will not jeopardize staff wellbeing or put equipment at risk of damage due to properties or sets having or being hazardous sites.
This includes entering a property where Covid has been identified. We will not enter such a property and reserve the right to cancel a shoot or project booking should a property or site be deemed to have infected residents at your expense, if we have not been made aware prior to shoot day. We will abide by standard government and ministry of health guidelines and we require you and any of your company representatives / vendors or property owners to take appropriate measures in line with official guidelines as above.
14.2 On specialist building sites all industry standard PPE must be supplied for Boundless Vision staff and appropriate risk management or hazards are to be identified by you or your company representative.
15. Licensing
15.1 We possess the capability to authorize the use of our images through a formal licensing process. Kindly refrain from sharing our images without prior confirmation and completion of the licensing procedure. The available licensing options, exclusive to designated license holders, are as follows:
Website and Social Media Commercial License: $250 excl.
This license grants access to a collection of photos (typically exceeding 30 images) for lifetime, perpetual use on websites and social media platforms.
